Tail Lights??? Drain Battery?

My 91 Legacy Wagons brake lights come on after a few minutes or more and stay on and drain battery after a few hours. I also noticed that the shifter makes a clicking sound and wont shift correctly when the brake is applied to shift from Park to Drive. Any suggestions?

Check the switch thats mounted to the pedal assembly,the brake pedal operates it as you will see.
